Standard Wills

You need to make a Will if you want to be absolutely sure that your estate goes to those you wish to benefit, and not whom the state has already decided upon on your behalf.


If you have children under 18 years old, Guardians need to be named in a Will. This is the only way you can deal with this otherwise your children automatically become wards of court, with the decision on their future being based on social service reports and made by people you don’t know and don’t know your children. They might not choose as you would. Imagine the enormous extra stress this would put on your children and relatives at a time of grief.


Common law partners must make a Will, as they may not inherit anything without one, even if they have lived together for years and have children.


A Will is one of the most important documents you can ever make and avoids uncertainty, anguish and long administrative delays, sometimes years, for those you leave behind.


However straightforward the circumstances are, it is important that Wills are written properly to ensure that they are legally valid when the time comes as the very nature of the document means that it is too late to put things right after any problems arise!

Care Home Fees

Are you concerned about possible future care fees reducing the value of your home to just a few thousand pounds? The constantly rising cost of care home fees can very quickly have a dramatic effect on what is probably your most valuable asset. But there is a way for couples to protect against these fees and thereby ensuring that you maximise the inheritance for your chosen beneficiaries.


Sideways Disinheritance

Couples may be worried that their children might become disinherited due to a surviving spouse making a new Will leaving the whole value of the property to any future new partner or unwittingly by not making a new Will upon remarrying (marriage automatically makes any current Will invalid).


Right of Occupation

You may have remarried or live with a new partner and want to make provision for them to live in your home after your death whilst protecting it's value for your children.


Discretionary Trust Wills


These types of Trust Wills can be used where one or more of the beneficiaries have a drug, alcohol or gambling dependency or have debt issues. Assets can be made available to the beneficiaries at the discretion of the Trustees but they do not have direct access or ownership of the assets.


Disabled Trust Wills


In the same way as Discretionary Trust Wills work, if a beneficiary is disabled, funds can be paid to the beneficiary at the discretion of the Trustees without affecting any benefits that the beneficiary receives.

Making a Will takes care of your affairs after your death.


But what happens if you lose the physical or mental capacity to manage your affairs while you are still living?


Do you remember the old term "Your health can turn on a sixpence"?


Never has this been more true, particularly with the increase of strokes and dementia within most age groups.


By having Lasting Powers of Attorney you can make sure that you choose the people who control your legal and financial affairs together with your health and welfare should this occur.


If a Lasting Power of Attorney is not in place, no one could act on your behalf without the time consuming procedure of applying to the Court of Protection.


They might not appoint the attorney that you would have chosen.


Even spouses or children can be left powerless and face long and costly delays.


There are two types of Lasting Power of Attorney: One that takes care of your Property and Finances and one that takes care of your Health and Welfare.


A final point for consideration: Lasting Powers of Attorney have to be in place before loss of mental capacity so sooner rather than later should be the rule.

It is also important that Wills are stored safely as they could be destroyed by fire or flood or get lost or stolen. 


When the time comes to administer your Will, if it cannot be found it is deemed by law that you never made one.


Our management service includes the safe storage of your Will together with unlimited updates that you wish to make.


The service also includes storage of any other documents that we have provided.
